The CLOUD Act requires US companies to hand data to US authorities, even when servers are located in Europe. Why does server location matter so much for health apps?
Under the GDPR, health and fitness data fall into a special category of personal data with heightened protection. US providers are subject to the CLOUD Act, which lets US authorities access data even when it is stored in Europe. European providers headquartered and hosted in the EU are not subject to this regulation and operate under the GDPR. Clue stores all data in EU data centres, and YAZIO uses a German hosting provider.
Are all the apps listed here hosted 100 percent in the EU?
No, this varies by provider and is stated in each privacy policy. Clue stores data exclusively in AWS data centres in the EU, and YAZIO uses a German host. Freeletics, Sleep Cycle, and Fastic, by contrast, state that individual backend or analytics services may transfer data to the USA, covered by EU standard contractual clauses. These companies are nonetheless headquartered in the EU.
Which app fits which use case?
For training, Freeletics offers an AI coach; for nutrition and calories, YAZIO or Lifesum each provide a food database and barcode scanner. Clue tracks the menstrual cycle and reproductive health, while Sleep Cycle analyses sleep and wakes you during a light sleep phase. Are there apps without any cloud connection?
Yes. nalua is a sensory breathing app that runs entirely offline on the device. There is no server backend, no cloud connection, and no data transmission to external services, so no breathing data ever leaves the phone. The app also skips advertising, tracking, and user accounts completely.
Are the costs of these apps covered by health insurers?
With 7Mind, several prevention courses are certified under §20 SGB V and can be subsidised by statutory German health insurers, for example on stress management, sleep, and relaxation. Depending on the insurer, costs are reimbursed up to 100 percent. For the other apps listed here, we are not aware of any regular reimbursement.
What data do cycle tracking apps like Clue collect?
Clue collects health data such as period length, pain, spotting, weight, body temperature, and sexual activity, plus account data and technical usage data. Many tracking fields are optional, and users decide for themselves which entries to make. According to Clue, this data is stored exclusively on servers located in the European Union.
